King ARE Trying To Candy-Crush The Banner Saga

KuppaKuppa Member UncommonPosts: 3,292

WOW, this is unbelievable...

http://www.rockpapershotgun.com/2014/01/22/king-are-trying-to-candy-crush-the-banner-saga/

King, the developers of "Candy Crush Saga", are going after Stoic, the indie developers of "The Banner Saga" for using their trademark word "Saga" in their game's name(which the patent is still pending for King). This is a big shame, obviously King is a company that doesn't really care about gaming and just cares about money. This is not to say gaming companies don't care about money but it's pretty clear a company like King has no passion about gaming, especially after going after an indie company over something they know full well is not true.

Truly sad story...

It all stems from the world's obsessive love and desire for money. It causes people to do completely ridiculous and stupid things without a bit of thought prior to it. Pure idiocy.

They won't win that lawsuit, best they could hope for is the Indie dev is so poor they won't fight it.

That is how Nvidia became a giant as well as Soundblaster, just sue your competition in hopes they give  up.

That is the sad reality of the world we live in,who and what the law actually protects is a mystery.

They successfully did the same with the word Candy so why wouldn't they try the same with Saga and Crush?

The problem is not solely the greed of the company involved but with the system of patents, copyright and trademarks right now.

If you truly want to protest this stop playing King games and purchasing IAPs.I doubt no matter how large the outcry is over this it will affect Kings profits though, consumers these days have the spines of jellyfish and will instead come up for rationales to excuse corporate behaviour.

This has been tried before with other stuff.  Trademarks are designed to protect an IP and to prevent confusion between brands.  It doesn't seem likely that anyone would confuse The Banner Saga with Candy Crush.

B@stards.  This better not start a round of developers suing each other like phone manufacturers sue each other.

I can not remember winning or losing a single debate on the internet.

They will get about as far as Microsoft did when they tried to sue the Lindows people for Trademark Infringement.  The judge in that case ruled that Microsoft's Trademark on the word "Windows" was not valid as it's a commonly used word throughout several industries and is therefor not protected under Law. I feel that the Judge in this case will find that the word "Saga" is of a similar nature.

Yeah because I'm totally going to confuse a shitty mobile game with a strategic PC  indie RPG. This type of thing shows just how broken trademark law is.

That settles it... I'm filing the the paper work to trademark the word "The".  The stupidity of the patent and trademark office in the US knows no bounds.

There's a game jam going on to get indie devs to try and produce a bunch of Candy-themed games before Feb. 3rd

Game jams are short (usually weekend-long) frenzies of game development where indie teams see how much of a game they can make before deadline. Sometimes remarkably good ideas are produced (for example, Superhot), although the purpose this time seems slightly more cynical.

Dude... What a fuuuuck? Are they serious or really, really, really retarded jerks? Authors of Bejeweled want words with them.

Edit: Actually, King.com did a perfect free marketing for Stoic. I'm buying The Banner Saga right now, as many more people who knows about this story. GG

I ran out of salt during that article. I really should have invested in those mines last year.

This is so much BS and I didn't think you could copyright common words like saga independently (as it has been tried before and defeated legally. I think they can claim candy crush as a game title but not either word alone for example as they are common.)  As many games as there are with word saga in the title... I just don't know where to begin. I am tempted to buy a copy of Banner Saga now.

this shouldn't even reach court, saga is a generic term, and generic terms can't be trademarked

I wouldn't be surprised if this whole thing was being blown out of proportion and statements were taken out of context or even fabricated.

I do not play Smart-phone Apps or even own a smart-phone, but my common-sense tells me that some of this has been grossly misinterpreted, and because it's the Internet, i take a lot of what i read written by others with a grain of salt.

Although if a lot of this IS true, it wouldn't shocking; as i think this may just be the Company trying to see how far they can stretch the Copyright laws and to also see what they can get law-makers to re-write.

Wouldn't explain how they were able to also trademark the word "candy".

Welcome to the US patent system.

I've read articles where they mention the only reason King might win it is because they have so much money, which has something to say about our law system...

Perhaps King are launching this suit in the full knowledge that it will generate tons of free publicity for their flagship title. And it will generate it in places that they could never reach with normal advertising spend.

They can't be doing it for the money, as their target doesn't have any and the game they're making doesn't compete with Candy Crush at all. There has to be an ulterior motive.
