It's not going to matter who he chooses, they'll be all over it. Personally, I'm hoping for a gay pro-choice justice. There are some on the list of possible justices.

Those Republican politicians (to be known henceforth as "21% er's for brevity's sake) are mostly clueless true, but even they aren't THAT stupid to try and block anyone Obama would nominate. It would just make them further the party of "No ideas... just No." and Americans would see right through it.
It should be a foregone conclusion that Obama is picking someone with moderate left leanings or writings to restore balance. He also needs to fill the court with another minority of some type; whether female, hispanic, gay or a combination of the three, lol.
Based on his law background, we can be sure that unlike Bush, he will have a proper understanding of someone's legal qualifications and this is extremely refreshing; so we won't have to go through a whole Harriet Miers embarrassment because we found out she got her legal degree from the back of a matchbook.
I found it funny that Bush was so sure Souter was "on board" when he picked him, and then Souter turned out to be a very fair judge, mostly siding against restrictive 21%er policies. This is what 21%ers do; this type of character assassination when you "cross" them:

Except he stated he wants someone who will judge based on "empathy and emotion". That is not how you make a ruling - you base it on law alone and leave out your personal feelings.

Your position is noted and in the STRICTEST definition of the "law", you are right. But I tell you what.
When I open the newspaper and read a story about a gun owner who forgot once to lock his gun and his only child that he and his wife went through years of InVitro fertilization to conceive, accidentally shot himself in the head and died and now the cops, judge and jury have no "empathy or emotion", only the law, and sentence him to 10 years for negligent homicide..
...or the grandfather who because of a small touch of Alzheimer's, went shopping with his granddaughter in the hot Texas summer, and forgot she was in the car while he went shopping and she boiled to death, and now the judge says "the law is the law", even though the parents plead not to break up the family further....

Sad events, indeed; however, I don't quite understand your point here.
The man gets negligent homicide as he should have gotten. It was his fault. Let me restate, empathize with them; however, that empathy should not deter the judgment.
The parents, in your second scenario, are at fault. Who, in all honesty, would leave their child with an individual, family or not, who has Alzheimer's? It was irresponsible parenting.
Your attitude is these people should not accept the responsibility and consequences of their actions simply because it was the death of their child.
You, stated I MUST pay taxes because it is the law, but yet you want to bend that law when you see fit? Obama's administration broke the law, according to you as well, and they suffered no recourse. Why? Because he twisted the law for his purposes.

Fillibusters are there to make frivilous things unpassable. Only actual important things get passed. If they pick someone who has memorized the consitution and studied it atleast in college, I think more republicans cannot object to the appointment unless they are just as bad as dems fillibustering an excessively overqualified justice.
They no doubt will cause a ruckus to fall in line with Rush's inevitable banter, all the while alienating a significant portion of the country and their own moderates. GOP business as usual.

so sad but true, the less our government is allowed to do, the better. We can only pray for griddlock with the crooks we have inoffice. As long as they can't agree on what bad policies to pass, we at least buy some time. When fewer laws are made it forces them to adhere to their designated role as 'steward" as was intended by our founders in the first place.

what does anarchy have to do with them creating and passing new laws that were never intended by our founders? That is not anarchy, not in the least, it is saying there is more than enough laws already on the books, we should be removing them, not adding to them. just adhere to the laws that this country was founded upon, as was intended by our founders.

The marriage amendments are not only contrary to the history and tradition of the United States, they are only legal because they used an improper means (initiative and referenda) to convince a bunch of people they were (a) saving their marriages or (b) saving civilization by take-away people's right to privacy, contract, association, and liberty.
*The word inalienable in the Declaration of Independence is not just a funny word; it was deliberately selected by a very wise man who told, and showed, us that our rights (life, liberty, and the pursuit of happiness) cannot be taken-away by anyone. Not even ourselves.
Honestly, I would not mind one bit if they stripped all the laws and privildges awarded to our federal government after our founding fathers passed . Bring it back to it's purity, and start over again.

People think the federal government should not be in the area of public health care (I disagree). People think the government should not be in the area of education (I mostly agree). People think infrastructure should not be an area for the federal government (I mostly disagree). People think green energy should not be a national priority (I really am not sure; it depends on the methods, means, goals, and so on and so forth).
We need to accept, and move-on, that the federal government is not going to shrink itself. Its priorities will only enlarge. We, the People, are the government; we delegate our authority to our representatives. They, in turn, set the vision for the country.
If you disagree, then you need to get involved. I see the government's involvement in public education as one of the most wasteful activities. I see the government's involvement in health care as a way to (1) increase accessibility, (2) reduce costs, and (3) improve care. I see the government's involvement in infrastructure as an opportunity to make our national economy more efficient in trade in goods and services. Obama wants to expand broadband access, and the for-profit firms refuse to do it because they are demanding more control, and so Obama will provide subsidies to increase access. It will make us more efficient as a country, and more productive and more prosperous.
The government can SPEND on anything it wants. YOU -- YES, YOU-- can determine what by getting involved.
We live in the greatest country on earth. Get involved. I am serious. They would be delighted, especially you younger people, if you got involved. Give it a shot. Go non-profit. Do something (anything). We are all better when citizens get involved in their communities from volunteering at hospitals to joining Congressional watchdog groups to town meetings. Just go if you do not want to ask questions. We need more citizens involved.
