The US Legal System: The Butt of too Many Jokes...

So I was watching the news as usual today when I see the outcome of the Andrea Yates trial (er re-trial thanks to semmantics ). If you're not familiar with this woman just drop her name in Google. In short she drowned her 4 kids in the tub.

So she's gets off with a verdict of "not guilty by way of insanity". Can someone explain this crap to me? I mean, anyone who is capable of cold-blooded murder is "insane" if you ask me. What a load of crap the punishment system in our legal system is here. So she gets locked up in an asylum for "treatment" which means she could very well be "cured" in due time and released? So these 4 poor kids are just crap out of luck when it comes to justice.

Just a minor rant on my part. You know, I hear people all the time bicker about government involvement in people's lives, but this really makes me think: Wouldn't it be nice if people have to be evaluated and get a license to breed?

Okay, so I am being a bit extreme. But at what point do we stop saying "Oh well, she was fine with the first 3 kids. It was that 4th one that made her snap. It's not her fault." ?

    Speaking from the point of the judicial scene, most of us consider this an example of pro bono legal siding (for the greater good, in other words).
    Some backstory: Andrea Yates was convinced that Satan came to her in a vision and ordered her to murder her children. She drowned something like four of her kids in a bath tub--all after a failed attempt at stoning them all to death, I recall. She claimed she was being spoken to and, fearing that her children were posessed, she set out to do "God's work".
    Some I have spoken to think her legal team created the circumstances and coerced her into stating that God's work was being done, a fact which is not entirely accurate. Andrea Yates had undergone psychoanalysis beforehand, and was deemed crazy. It only follows that in her schitzophrenic reality she was firmly convinced that she was only preventing devil spawn. Her legal team understood this fact, and liberally referenced her clinical insanity to both the jury and the judge.

    Prison is for individuals who are fully aware of what they have done wrong and who will make amends in the future. She does not fit into *any* such category. She is firmly convinced otherwise, and no sentence could bring her to sense. I think it was fitting that she go to an Asylum wherein she can be heavily sedated and locked up just the same.


    (Besides, if you ask me, all killers are insane, but I digress.)

       Oh my... I actually agree with Merodoc! Well, I couldn't find anything in his post to disagree with! I'm so scared right now...

       Uh, side note: Wouldn't she not have thought that whole "Devil and God's work" thing if she hadn't been raised to believe in those things?

       (Note: I am not trying to start an arguement about religion here. I am just noting something. I am not saying that religion is wholly responsible for the children's death, just that it gave her mind something it could not handle. She was insane, and could not cope with it, is all.)

    Too bad her children weren't taken away from her when they found out she was schitzo and unfit to be a parent. Oh wait, they probably found out she was crazy after she killed the kids. That makes more sense.

    Don't be terrorized! You're more likely to die of a car accident, drowning, fire, or murder! More people die every year from prescription drugs than terrorism LOL!

       Uh... How did the seven and five year olds not get away? You'd think at least one of them would have. I mean, I don't know about you, but if someone's trying to kill me and there's no chance of defending myself, I run. I mean, if they split up, at least of of them could've gotten away... Some parents suck hardcore...

    When I was seven, I obeyed my parents. I certainly did not expect my mother would try to hurt me. Regardless, Andrea Yates seems jacked, so I think she could've subdued her children before that... thing. Ugh.

    Andrea Yates :"Yo, I'm freaking crazy foo! I killed my kids cause I am so freaking crazy."

    Judicial System : "So your plea is Not Guilty By Reason OF Insanity?"

    Andrea Yates :"That's what I said yes basically."

    Judiacial System :"This court hereby finds Andrea Yates NOT guilty by reason of insanity. Bailiff take Ms. Yates out back and have her shot, because insanity cannot be cured."

    There now let some more people plea insanity.

    Seriously though, I think she should be locked up, and when finally deemed "Not Crazy" Should continue with the sentence. Yes, you were crazy when you did it. But somebody has to pay for it. And that craziness, whether you like it or not, is still a part of you.
