NCSoft Sued?

Quick little read for everyone. I am a little lost as to WHY NCsoft is being sued.

http://www.tgdaily.com/2006/03/02/ncsoft_sued_230million/

From my understanding they didn't actually do ANYTHING with the accounts themselves. They were hacked. Next we're going to see Smith and Wesson sued becuase one of their guns shot someone. Is it just me or is the Legal World actually losing IQ points as we speak?

Well, you know how you feel when you wait for an MMO to come out and when it does you feel like you've paid to play it's beta test for another 6-9 months before anything even thinks of working the way it should? Being a network engineer you feel that way about anything Microsoft puts out."

Thats the stupidest news ive ever heard. The same Asians that are sueing are the same ones that hacked im sure. Maybe not THE actual hackers, but you get the point. NCsoft is not a fault here, because they were screwed over by the hackers just as much as the players whos accounts were stolen.

Actually there has already been 1 small US handgun manufacturer sued out of business. As for your question the answer is either 'yes they are' or 'When did they have IQ points to start with?' depending who you ask.

Harlee, while I think I know what you are getting at, I don't agree with it. Suing NCSoft because they got hacked is stupid. Suing NCSoft becuase they got hacked, had the accounts reported as stolen by the clients, were told to cancel and remove the charges to said accounts becuase they were done wrongfully, and NCSoft does nothing about it would be an entirely different story.

The article isn't really too deep as to covering NCSofts response other than "The accounts were made in good faith". It doesn't tell us whether or not they are reversed charges or the like. If you buy a car and someone steals it you don't sue the Car Manufacturer because they should have had more "s e c u r i t y". There's a definate level of responsility the USER has when it comes to their info. I don't know about you but if it takes me months to realise someone has been charging fees to my card for something I didn't authorise then I don't deserve the credit card.

This is all along the same lines as the people who sue someone because they injured themselves while breaking into the house. Eve Online recently had accounts hacked, they found it and dealt with it ( to some extent but that is a WHOLE other story from me ). If NCSoft was made aware and they tried to rectify the mistake then suing them is pointless and a waste of time and resources. If they just said "Tough luck" then I can see the legal procedings.

I was actually thinking about what I had heard about a gun company being sued into oblivion when I used that analogy but I just let it run anyway.

And if I had to pick which answer you chose to my question I would have to go with the second :P

yes but the arguements there were different the handgun companies that went out of buisness were pushed out through one of these.

    1. something about the mechanical workings of the gun made it legally questionable.

a great example is the colt 25 caliber midnight special(yes this gun does exist but it is rare as hell), this gun was made so if you changed the barrel you changed the balistic signature that goes on the bullet.

what happened wasnt that colt got pushed out of buisness or sued, but there were threats and they were basically forced to stop production.

    2. the advertising on the weapon. there is an actual case on record where a gun shop was sued for advertising to "a criminal dangerous audience", however since the shop did the necessary checks and whatnot the case went nowwhere.

    3. Guns made to be modified into much more dangerous toys. There was a law and order about this but there have been several actual cases and issues like this.

this is when the mechanical mechanism of the gun is made so that it can be easily modified to be fully automatic. as opposed to the normal mechanism where it is hell on earth......

but the NC soft case i think is interesting.

i think NC is more accountable for hacking then most companies due to its sheer size and ability to financially spend. they could have a hell of a lot better security.

and that is what the case is really about in my mind.
