It appears that Darkfall's trademark owner, Aventurine, has let its trademark laps. Accidental or intentional?
When you look up Darkfalls serial number (78284269) at http://www.uspto.gov/, the current status states:
"An office action suspending further action on the application has been mailed."
Where does this leave the long awaited game? Will Darkfall take on a new name or disappear like other games before it (Warhammer Online)?
Personally I hope the Darkfall developers will get the matter straightened out and production will continue on as planned.

This is an old, old question. Don't worry about it. It is really a non-issue.
Darkfall Chronicles hasn't updated their website in months.

Seriously though, I'm a lawyer and intellectual property law is so complex
that regularly licensed lawyers in the United States are not allowed to practice it without passing a
patent bar exam. Very few of whom pass.

So unless you have been counseled by an attorney versed in international intellectual property intimate with this case who has analyzed all the facts in this particular case - don't even start with throwing up red flags.
To top it all off, who cares if the name is Darkfall? Changing the name won't make or break the game. So, yeah, this trademark issue is really a non-issue and you're wasting time even thinking about it.
