    NDA is a legally binding contract you enter into with free will.  If you break the contract, you can be sued.  Granted, almost nobody ever really does get sued though lol.  It's used so that bugs, coding, secrets, content that are in Development, Alpha, and Beta stages aren't leaked.  All employees of game developers must sign an NDA, so that what is said in meetings and planning sessions aren't leaked out.  It would be horrible if you talked about making an MMO, then it gets leaked, and someone beats you to the Trademark/Patent offices.  The same goes for players.  If you've ever played an early alpha, or in some games, a beta, you'll know there are bugs, some gamebreaking.  This isn't a released version, so they don't want people coming out saying things about stuff that won't be there in the launched version and scare away potential consumers.

     

    Good developer's use Beta testers.  Look at swtor for example,  there were bugs in beta, and they didn't listen.  So they couldn't get enough players to pay for a subscription.  Look at WoW for example, there were bugs in beta and they did fix most of them...and we all know that story.

    Game NDAs, like game EULAs, are useless. You will never get sued for one unless you're making shit tons of money off the game (which then they will combat that shit tons of money with very expensive lawyers).

    On the flip side of things, I have had to sign real NDAs being a software dev, those you can get sued for lol
